TERMS  &  CONDITIONS 

 

 

 

 

  1. APPLICATION

 

1.1 The following Terms & Conditions (hereafter: “terms”) apply to all offers, contracts and other agreements made between Karine Kaelin Interior Design (hereafter: “Karine Kaelin”) and the client. 

1.2 The terms & conditions of the client are not applicable.

 

 

 

2. PROPOSAL

 

2.1 A written proposal for the project is created free of charge.

2.2 The proposal will include a description of the project and design process.

2.3 A proposal from Karine Kaelin is valid for 2 weeks after the date it was created.

 

 

 

3. CONTRACT

 

3.1 The contract refers to the description of the assignment in the proposal.

3.2 If the content, scope or desired result of the assignment changes during the design process, an additional agreement needs to be made or the assignment will be terminated and a new contract 

will be proposed.

3.3 Karine Kaelin reserves the right to charge for design fees, project co-ordination fees, delivery charges, installation fees and storage fees. Storage fees may be charged if the client delays their project and it is necessary for Karine Kaelin to store the goods beyond the original agreed date. 

 

 

 

4. PROJECT EXECUTION

 

4.1 In case the client would like to make significant changes to the design in a way that doesn’t align with the original creative brief, the costs of these changes will be charged.

4.2 The client agrees to provide feedback on all creative work within a reasonable time frame (usually five working days).

4.3 If a client deliverable - such as input, approvals or payment - is late more than 10 working days, the project will be considered to be on hold. Once the deliverable is received, the project will be rescheduled based on Karine Kaelin’s current workload and availability. 

4.4 In case something is wrong or missing compared to what was agreed in the contract, the client has two weeks after the design is completed to let Karine Kaelin know in writing.

4.5 If the client reports this later, the costs of any additional changes will be charged to the client.

 

 

5. USE OF INFORMATION

 

5.1 All scheme designs generated by Karine Kaelin remain the property of Karine Kaelin. By allowing Karine Kaelin to photograph her project at the property/project location the client agrees to allow Karine Kaelin to use the photographic image for promotional purposes. Client testimonials may be used by Karine Kaelin for promotional purposes. 

 

 

 

6. PAYMENT

 

6.1 Invoices sent by Karine Kaelin will need to be paid within 7 working days.

6.2 If the payment is not received within 7 working days, interest at the rate of 5% per month shall be payable on all accounts not settled by their due date.

6.3 To confirm acceptance of the design proposal, the client pays a non-refundable fee as described in the design proposal.

6.4 The remainder of the design fee will be invoiced in pre-agreed stages as the design work is completed.

6.5 Payment for materials, furniture or other items relating to the agreed design schemes will be invoiced prior to orders being placed. No orders will be placed before payment.

6.6 Any work that extends beyond the original brief will be charged at an hourly rate of £45.

 

 

 

7. GOODS

 

7.1 The client has 5 working days after having received a proposal to give feedback/approval to Karine Kaelin to place orders. After this time frame, Karine Kaelin reserves the right to charge additional fees if the goods in question are not available anymore and items need to be resourced.

7.2 Although Karine Kaelin makes every effort to display the colours and textures accurately, the product you receive may differ slightly from the samples or images.

7.3 Karine Kaelin is not responsible for the quality, durability, or availability of products selected.

7.4 Karine Kaelin is not responsible for delays outside her control. If her supply of the services or the goods is delayed by an event outside her control then she will contact the client as soon as possible to let her/him know and she will take steps to minimise the effect of the delay. 

7.5 Goods will be the client’s responsibility from the time they are delivered to the address the client gave to Karine Kaelin.

7.6 The client only owns a product once Karine Kaelin has received payment in full.

 

 

 

8. REFUND

 

8.1 If the client changes her/his mind about goods, the client may be able to get a refund if she/he is within the cooling-off period (cooling-off period depends on each supplier’s terms & conditions). This may be subject to deductions and the client will have to pay the costs of return of any goods. 

8.2 If goods are delayed by an event outside Karine Kaelin control and there is a risk of substantial delay, the client may contact her to end the contract and receive a refund for any products that were paid for but not received. However, sourcing fees will not be refunded.

 

 

9. CANCELLATION AND TERMINATION POLICY

 

9.1 The client has the right to cancel the contract at any time up to the end of seven working days after the day on which the contract is concluded on condition that the supply of the services has not begun. A working day is any day other than weekends and bank or other public holidays. 

9.2 To exercise the right of cancellation the client must give written notice to Karine Kaelin by hand, post or email.

9.3 Once the client has notified Karine Kaelin that the client is cancelling the contract, Karine Kaelin will within 30 days refund the client for the services not actioned and completed. 

9.4 Following the seven day period, the client has the right to terminate the contract at any time giving notice in writing to Karine Kaelin. The client will be liable to pay Karine Kaelin for the services provided to the date of termination (including but not limited to services already performed, goods and materials supplied or ordered on the Client’s behalf, any services that may incur cancellation fees and any travel or accommodation costs incurred by Karine Kaelin). 

9.5 Termination of contract will not affect either party’s outstanding rights or duties, including Karine Kaelin’s right to recover any money owing to her under these terms and conditions.

 

 

 

10. LIABILITY

 

10.1 Karine Kaelin is not liable for errors and mistakes by the client or third parties or inaccurate information supplied by the client or third parties. 

10.2 Karine Kaelin is also not responsible for any damage that may result from the use of the design.

10.3 Any liability of Karine Kaelin is limited to the total fee that is invoiced for the project concerned.

10.4 Karine Kaelin excludes all liability and responsibility for any uninsured loss or damage that may result to the client or a third party in connection with the supply and installation of goods. 

 

 

 

11. DISPUTE

 

11.1 English Law is applicable to all agreements made between Karine Kaelin and the client. 

11.2 In case of any disputes between Karine Kaelin and the client, English courts have exclusive competence.

 

 

 

12. CHANGED TERMS

 

12.1 Karine Kaelin may at any time amend these Terms and Conditions. 

12.2 Such amendments are effective immediately upon notice to you by Karine Kaelin.

12.3 Any use of the Service by the client after being notified indicates acceptance by the client of these amendments.
